Navigating the Haze: Understanding the Current Legality of Cannabis in Virginia
Virginia’s cannabis laws have undergone significant changes in recent years. The current legality of cannabis in the Commonwealth can be confusing, so let’s clear the air. VA was the first southern state to legalize adult recreational use. As of December 2023, there are 22 states that have legalized cannabis for adult recreational use. Let’s dive into the state of cannabis laws today, as of February 2024.
What’s Legal?
- Adults 21+ may possess up to 1 oz. of cannabis
- Adults 21+ can use cannabis in their private residences
- Adults 21+ can grow up to 4 cannabis plants per household
- Limited medical cannabis dispersion through the VA Board of Pharmacy
- Sale of cannabis products with less than 0.3% THC
- THC threshold applies to delta-8 and delta-9
- Products must bear a label from an accredited laboratory confirming contents
What’s Illegal?
- Any person under the age of 21 using or possessing cannabis
- Sale or distribution of cannabis…
- containing more than 0.3% THC
- in non-child-resistant packaging
- *It is expected that sales of recreational cannabis will begin in 2024, per provisions in the law*
- Consumption of cannabis in public
- Any product, either meant to eat or inhale, containing synthetic THC
